It's also possible to report a hate crime as a third party - meaning that you don't have to have been there or witnessed the incident, and the police are obliged to investigate it. Or worse, maybe the CPS were worried that her assertion that shoe "couldn't be racist because only white men can" would actually hold up in court. Although as dysfunctional as they are, I'd still be surprised if they couldn't win that argument.
