The trick is that they never will call it simply possession, they will call it intent to distribute or trafficking no matter how small. Plenty of people have been jailed for 20+years for marijuana

Get the sample size thing but wasn't really going for the scientific method argument here. It's an argument based public opinion, "doing better in life" "making poor life decisions," which don't lead to any real arguments. The analogy about smoking you made doesn't really hold because that one is easily quantifiable, smokers on AVERAGE have a variety of health risks including lower life expectancies. Instead, a analogy about another public opinion would be better. Anyway
