From personal experience working in a magistrates court in Australia that deals with domestic violence and sexual assault almost exclusively. I'm not a lawyer, though there are two in my immediate family who I asked about this. I worked security. It could be different elsewhere in the world, but most of these cases are solved in magistrates court here and it's only if it escalates for some reason they would look into criminal proceedings.

Cases of sexual assault are USUALLY prosecuted by the state (the police on behalf of the aggrieved) vs the individual in CIVIL court. It is a minority of cases that evolve into criminal cases.

99.9% of the time there is no jury. There is a judge with 50 cases on their ballot and one side has money and lawyers while the other side has free legal aid.
