Quitting your job is NOT a solution. Once the support order is in place, even if your pay is reduced the court can rule that your earning below your earning ability and leave support unchanged. If you are fired from your job support arrears will accrue and once you start working again they can garnish up to 50% of your pay depending on the state you live in. Based on what you’ve shared she is legally obligated to provide financial support, and in at least Washington and Texas I can tell you, her current employment status is irrelevant, only her earning history matters. A support amount will be calculated using the state mandated guidelines and based on her earning history, after the support order is entered, she is obligated to pay you.
