It's because in italian gender neutral doesn't exist. The grammatics rules states that when something that is being referred is supposed to include both male and female, the correct form to use is the male one. For example, "a group" of people which is neutral and includes both male and female, in italian it's called "il gruppo" which is the male form. But it doesn't translate too well in english. Here in Italy rape is legally definied as "Rape is a crime that happens when someone illegally use his strenght, his authority position or other coercitive methods to force someone else to make or undergo sexual acts without consent" It's gender neutral and includer any sexual acts, so it works EDIT - people made me notice that it doesn't translate really well, but in italian it's gender neutraul so it works

Well it's out of the hands of the judge. In 2007 the Nevada Legislature removed any discretion from a judge in the sentencing of lewdness with minors and set a blanket mandatory life sentence for all offenders convicted of the crime. So yeah, she was guilty = automatic life sentence.
