I agree that she should be truely punished and that he needs justice and compensation. What I am saying is that he's in a fragile mental state that doesn't allow him to cope with more stress, he should focus on his recovery before doing anything of the sort. It is a crime. The issue is two fold imo: The punishment is generally lighter than the bogus crime the victim of defamation was accused of. They are supposed to, but few do. Bias tints our judgement systematically and sneakily. The best judges can do is train continuously to limit its influence. But I don't know of any effort in any judicial system that does it.

You're right, but what matters is the judicial system's perception. We a mostly unaware of our biases and take our perception for reality. So, if the police and the judge unconsciously think of the defendant as female, the female bias will apply even if they consciously know they are trans. This phenomenon is very powerful and subject of many research in different contexts/fields (ex. Justice, medical, work, education, etc.)

Thank you for making the distinction and clarifying this for me. I'd add, that for a pedophile (he/she who has a condition), there should be appropriate risk assessment to avoid tragedy. What triggered me was the concept that somehow the gender of the victim and the criminal reduces or aggravates the severity of the offense. WTF?! P.S. for me child rape is way more serious than murder! This should have the hardest sentences. P.S. 2 the worse the offense, the harder truth should be established.
