I think, as is almost always the case, the middle way is the optimal path. To me, the post in here is about setting the frame for those of us who are having a hard time talking to women while we are out. I know when I think of talking to a girl while I am out, asking a girl out, I feel like it is something tough, something hard, something that is fraught with negative emotions. it is far from that simple. Do you consider taking someone's photo without their permission or knowledge grossly unethical? I think clearly, in a public place, an audio recording is not beyond the pale in any regard. If you stop and think about it you are recorded very frequently throughout the day by countless cameras, one guy recording his interaction with people is tame.

So, what seems to make sense for me (in part because my tendency is to be an IW as it were) A1 is starting the conversation, A2 is she showing she is interested, A3 you showing interest. If everything else hasn't happened, if she doesn't dig you sexually why have a prolonged conversation, aka C1? If she isn't interested in you, move on. This feels like the right answer. My first instinct was to do as many other suggest, make something funny out of it but if anything is clear to me it is that my instincts can not be trusted. Additionally, if you get pulled into their frame at all, then when they try and insist you give a straight forward answer it makes it harder to resist. The conversantional momentum is all wrong. "Unwelcome " is mentioned in the above text you posted. It is very reasonable to assume that attention by attractive people is more welcomed than from unattractive people. It is also reasonable to assume that it could be harder to prove it was unwanted even when it was. A casual comment in an email, a harmless flirt could wreck a case that someone had for a legitimate complaint.
