No it's a threatening display of a firearm. Simply having a gun in your hand pointed at the ground is not brandishing. Also, there would have to be someone who could visibly see it for brandishing to even be possible. If Im standing in an empty parking lot with my gun at my side, am I brandishing? If you think I am? Appeal to authority? What in god's good name are you stuttering about now. Say it with me, professional firearm instructors. It's what they do for a living... That's all they do. They know more than you. It's not an appeal it's an education. That's why you get training. That's why you read the laws.
