I suspect the recommendation comes from experience in the family court system which basically boils down to that CFI's and PRE's are the wild-west with a lot of influence, little oversight, questionable qualifications, and we're all rather subject to their whims. ProPublica recently published a really good article on it.

There's my lawyer and my ex's lawyer, is that what you're asking about? My lawyer says we could have requested a 'rework' of the CFI report where another CFI comes in and re-reviews everything, but my lawyer missed that deadline, the judge has made it pretty clear they won't extend it or grant another opportunity, and my lawyer seems pretty convinced it will likely just turn out worse than the original recommendation, but they've never really elaborated when I ask.

I thought so too, which is why I was surprised my lawyer waffled so quickly, especially once they admitted they never went over the evidence I had provided to begin with. I think that's the thing that's killing me - I HAD prepared a case to defend. I was asking for strategies. They weren't even prepared to shift gears when I wrote paragraphs calling out and refuting the CFI report to my lawyer within an hour of receiving it. I'm still really upset at how badly my attorney fucked that up.

Yeaah I've been hearing that thrown around a bit here too, yet it doesn't seem to apply the other way around. She used to hit me and I have evidence: She doesn't do it anymore so no biggie She ripped my shirt off, left bruises & scratches, and I was holding our baby at the time: Yeaah but that was like a year ago right? 70 is only a fraction of what I have too :( What's crazy to me is I've interviewed a few lawyers now and they all seem to be of the same position - that getting a PRE or going to trial is risky - and none of them have been willing to agree to listen to all 70 should I hire them, and one even bluntly stated that a judge will favor a CFI report over my evidence because "it's easier". I didn't have high standards for our justice system but this is a friggin circus beyond comprehension.

I noticed - when we split I moved all of her stuff to a storage unit. I told her where it was, gave her the codes and tried giving her the key but she refused to take it, stood outside pounding and kicking my house, then eventually went to the PD and came back with a 3-car escort 'for her protection' and to 'just to make sure I didn't miss anything' then tried to lecture me on tenant eviction laws. I couldn't get a TRO even when I demonstrated my ex was physically abusive and pounding/kicking my doors & windows, and even came by with some friends while I was gone for some light breaking and entering.

Oh man, I wish I knew how to get where you are. I have so much evidence of my ex's abuse of our child, but so far I can't even get an attorney to even review it all with me and I'm having to 'convince' them this is worth fighting for. They seem to think it's a waste of time and I should just go through the system's waypoints without question. Meanwhile, she is constantly lying and no one seems to care when I say I can prove it.

I have a similar story but it was the license plate on her car which was under my name still despite having signed the title over to her a year prior. She started getting parking tickets so I asked her to update the title & registration to her name and take care of the tickets. She said she would, then never followed through but kept on getting tickets. I tried calling and explaining that the vehicle was no longer mine but they needed paperwork from the DMV showing that, which I couldn't provide…

I can, but it would have no impact on their report or my case. My lawyer says the only things I can do at this point is get a PRE which they feel will make things worse and the court may deny anyway, or go to trial and put the CFI on the stand.
