I really think kids need to have more of a say, but at the same time, my parents bad mouthed each other and tried to sabotage my relationship with the other. I mostly agree that the rapist shouldn't have visitation rights, however it's most likely that the woman was acquaintances with the man. Your key word is also he can sue, doesn't mean that he will.
