2	Damn Right I'm not making the assumption, the assumption is made by the legal doctrine(disparate impact/adverse impact) that discrimination is possible. Its just up to someone to push it. Its a common enough case that is made. Plenty of companies have gotten in trouble for having people promoted who were disproportionately white and unable to prove it wasn't discrimination, for instance.There was an adverse impact on a protected group, and they failed to provide adequate reasoning why. 4	Damn Right It sounds to me like you are just trying to pick a fight, tbh. Maybe the men were trash, maybe the women were better. Disparate impact is unintentional discrimination, which could stem from unconscious bias among other factors. Its a well established legal doctrine for discrimination. However, women make less long term as they are more likely to take maternity leave, or people are worried they are going to take maternity leave, and thus pass them up for promotion.
