The legal concept to which you’re referring—the presumption of innocence—means only that the government needs to prove the accused’s guilt in criminal proceedings. Consider this as contrasted with presumed guilt. A system with presumed guilt would see far more convictions, as the burden of proving innocence falls on the accused. Again, this applies only to the government in criminal proceedings, but is the cornerstone of American jurispridence. Individuals can believe whatever they like about wh…

Agreed. Women presently have an incredible advantage in the family courts primarily due to decades of feminists lobbying. Even an ostensibly gender neutral section of the family legal code, when situated in the broader context of other pro-women laws feminists helped pass, are clearly discriminatory against men. For example, in California, domestic violence law is written in a way that assumes men are always perpetrators and women are always victims. This comes from the academically discredited,…

I think the split calculation is unfair because it encourages mothers to work less because they're getting paid child support. Not only does the split calculation provide the parent receiving support a disincentive to work for the reason you stated, but it also provides the supporting parent with one as well. The more you earn, the more you pay, and the more you pay the greater the disincentive for the supported parent to earn their own way. The way the system is designed creates a dependency in…

Listen man, I have a question. Are you saying that there is no way for you to petition the court for a variance from the guideline amount? There's no mechanism in the law that allows you to qualify direct child related expenses as a hardship and/or a special circumstance? Never mind, I found it. But for fuck's sake New Hampshire law is harsh. Have you asked the court to reduce your obligation under section 458-C:5 (I) (d)?: Reasonable expenses incurred by the obligor parent in exercising parenta…

I mean, maybe OP is being a little dramatic here, but as a Star Trek fan, I have to agree that Discovery was very disappointing. The writing was at best mediocre, and the blatant appeal to what the writers must have imagined were sjw sensibilities didn't help matters. As others have noted, Star Trek has long been socially progressive. Previous series have managed to include strong, complex characters from diverse backgrounds; DS9 had a trans woman who held her own with (and occasionally bested) …

We do, issued in San Francisco Court approximately 6 years ago. I can't find it just now, but I'm pretty sure that her lawyer incorporated a stipulation that before either of us initiates a court action, we must engage in mediation. I brought this up to the judge and he declared that the ex parte hearing was mediation. I call bullshit on this. I think by requesting the hearing, she violated the contract. Realized I didn't answer your question. We agreed to have the case transferred to Sacramen…

She prepares her own meals and remains in the home, by herself until father returns from [work], around 1 am." sic throughout. Sacramento. We currently have an arrangement for zero child support, but it wouldn't surprise me if she decided to ask for it. At present her income is zero because she runs (illegally) a catering business out of her apartment; it is unregistered and she pays no taxes. Hopefully the court finds that relevant if a determination of support is to be made. I absolutely will update sometime tomorrow.

This is spot on. Unfortunately, issues like domestic violence that evince a reflexive, highly emotional response seem to preclude a great many people from digesting a well reasoned, logical analysis. It could well be true that President Trump personally believes Porter to be guilty while publicly reminding Americans that accusations do not equal guilt and that a fair consideration of the evidence in a court of law (imperfect as that process may be) allows for more equitable outcomes. What would you have me do? I've already written the BSA to register my disapproval. At the end of the day, it's a private organization that can set policy at its discretion. If the nation weren't so divided about the race issue then maybe we could actually work together and fix the problem with law enforcement. But no, it's race. 100 percent agree. This is exactly what's wrong with the Black Lives Matter activists (besides their terrible name which fails to clearly communicate their point. It should be Black Lives Matter Too.) The fundamental problem is police abuse of power and lack of accountability.

According to the most recent census data, there are nearly 160 million more white people in America than there are black people. White people make up roughly 62 percent of the U.S. population but only about 49 percent of those who are killed by police officers. African Americans, however, account for 24 percent of those fatally shot and killed by the police despite being just 13 percent of the U.S. population.

And trust me, it’s sad to say no to a beautiful girl who is grinding her butt on your crotch, only to watch her leave the bar with some other guy because you’re one of the good ones. But at least you aren’t going to be a date rapist. I understood the point of the article. But I also listened to what he was saying, and not just what he was arguing. Disagree with the article. I do agree that not fucking wasted girls is good self defense, but fucking wasted girls who initiate by grabbing your dick is not rape. I will never buy the argument that drunkeness robs women of agency while leaving the agency and accountability of men intact. You're not "taking advantage" of drunk girls if you're drunk; you're both having a besotted good time. Yesterday it was reported that Amber was forced to call the police when members of Johnny’s team entered her home to remove his items, with the action potentially violating the restraining order even though Johnny was not present at the time. This is probably the most important sentence in the whole piece. TROs are fucked up because they are granted with no requirement of evidence and with no hearing. It is the practise of the California family courts to award spousal support for a term equal to half the duration of the marriage for short term marriages. That means Heard is looking at an alimony award for about 7.5 months. My guess is she wants more. In California--a Duluth model, believe the complaining witness state--false claims of domestic violence frequently appear in divorce cases, giving the female "victim" huge leverage. Domestic violence allegations seem to closely follow consultatio…

MRA smear time: But MRAs specialize in a very particular, and very toxic, brand of blaming women. This movement says women are the problem, and that women's complaints about sexism are really about nothing more than oppressing men. It invites you to take the "red pill" and see how deep the misandrist rabbit hole goes. It's an ideology that inspired Elliot Rodger's murderous rampage in 2014. 1, MRAs generally speaking are anti-feminist, not anti-woman, which is another way of saying we're pro-equ…

Assuming the statistics you quoted are correct, part of the reason fathers don't contest custody decisions is because they have the sense that it is hopeless, at best a pyrrhic victory in which they may win some amount of time at the cost of solvency. Anecdotally, I fought hard for custody, a battle that in just the first six months cost me $34,000. In your stats, the fight might not show up as contested because the case has never gone to trial. The article also points out that Norwegian society held certain assumptions surrounding the care of very young children that, followed strictly, resulted in outcomes not in the best interests of some of those children in general, and Anders Breivik in particular. That is, that the mother is the person best suited to caring for her child. I'm not sure how I feel about this. It's unclear whether the father lawfully (and fairly) brought his children to Lebanon in the first place. Regardless, however, it seems he did so because he feared that any family court proceeding would be biased against him. I feel bad for the children; had the mother prevailed, they would have lost their father, and because she did not, they've lost their mother. I empathize with the father, however. The MPDG trope means nothing to me. It has absolutely no bearing on men's rights issues such as family court reform, educational parity, mental health, suicide prevention, criminal justice reform (especially with respect, but not limited to the Duluth Model), among others. The MPDG trope, such that it is perceived to exist, is something you may want to ask feminists about.

I forgot about Unruh. I'm not sure where I stand on this. On the one hand, in certain contexts gender segregated spaces make sense. On the other, it may be better to promote non-discrimination as a value superior to cultural preferences for separate spaces for men and women in fitness clubs and barber shops. Minority rights vs the tyranny of the majority. In any case, either both Curves and Hawleywood's can continue to discriminate, or neither of them can. Curves still promotes itself as a fitne…

“A business that excludes women, refuses to serve women and that confirms a discriminatory policy in its advertising is in violation of the law,” Allred said. And yet Curves, which restricts its membership to women, is completely fine. Perhaps the way Hawleywood's Barber Shop can maintain its status as a male-only space is to become a private club, selling memberships to men for some nominal fee.

And additionally, maybe a lot of women prefer not to work, seeing homemaking as their sphere. This is true of the Mormons I've encountered. This is neither to defend nor decry religious adherents who choose traditional roles. But it should be obvious by now that the wage earnings gap is primarily a function of women's choices and not gender discrimination. Hopefully research like this can help steer the discourse on the earnings gap away from the sexism against women bogeyman. I'm not holding my…

When Justice Ruth Bader Ginsburg is asked how many women would be “enough” on the Supreme Court, she always answers unequivocally: “Nine.” After all, there were nine men on the court for nearly 200 years. Now it’s the 21st century. Why not nine women? Ginsburg’s quip reflects a deeper truth: The deeper truth being that feminists seek revenge, redress for what they perceive as historical wrongs, to punish today's men for the alleged sins of their fathers.

If your Magic cards are stolen, it is possible to confirm that you no longer possess them. This doesn't prove you were the victim of a crime (perhaps you accidentally threw them out), but at the least we can determine that your cards--Moxes, dual lands and all--are gone. In Kesha's case, we can't even determine whether she was a victim or had consensual sex. I take issue with OP's title. Charlotte Proudman is not at all confused, and there is nothing contradictory about what she wrote. Proudman is a female supremacist, and she makes that very clear. She feels that women are oppressed in the current order and seeks to advance a new, non-egalitarian society in which women's well being is the top priority, and in which men are seen as possible threats to female primacy, to be dealt with in whatever manner necessary. You need professional legal advice. If you haven't much money then I'm not sure how you might come by it, but this issue sounds sufficiently complex to demand it. The only other thing I can think of is that you should talk to your daughter's doctors and/or get a second opinion regarding treatment. Sort of. In California, child support is a function of parenting time, child related expenses (called add-ons), and relative incomes. If she made a lot more than him and/or he paid significant amounts of money for the child's education, health, or other care, she could end up owing him child support even though she has physical custody over 90% of the time. For those with means, add-ons are one way of ensuring that money you earn and pay out for your child actually benefits your child. The add-o…

The problem is that the line is fuzzy between fighting for victimized people and promoting a victimhood culture. Where does the former stop and the latter start? First, look at the role of free speech in the debate. Victims and their advocates always rely on free speech and open dialogue to articulate unpopular truths. They rely on free speech to assert their right to speak. Victimhood culture, by contrast, generally seeks to restrict expression in order to protect the sensibilities of its advoc…

For those of you who are unaware, these posters are ripped directly from the Duluth Model's power and control wheel. Edit: As some have pointed out, I (mistakenly) originally posted a link to an edited version of the wheel. The original is unambiguously anti-male. Link is now to the original version.

Well, the ManAlive group has taken feminist ideology to an extreme. The group involves a text that is full of jargon its founder made up, but that is consistent with patriarchy theory, so bear with me here. In the ManAlive view, men--and, of course, only men--are violent because their inherent "right to rule" becomes challenged, what they call a "fatal peril." That is, as a man raised in this society, all men believe they have a right to rule over everyone else by dint of their maleness. Wheneve…

I can't ever imagine getting married again. LTR? Sure. Marriage? Um, no. I still recognize, however, that my ex is pretty exceptional. Despite what /u/Tyronaut said elsewhere in this post, borderline personality disorder is not synonymous with being a white woman in the 21st century. My ex has a serious condition; I'm at a loss for words here; her brain works differently than most people's. Anyone who has known anyone with bpd knows what I mean. One of the most pernicious aspects of this--for he…

These programs were all rooted in the Duluth Model which is a feminist conceptual model that attempts to describe why domestic violence occurs and how to end it. The feminist thinking is that men are socialized in a patriarchy to use violence as a means of asserting their power over women. In this view, because men are the power holders in society, only men can use violence in this way. If women are violent is in self defense; perhaps against a particular man, or perhaps against the patriarchy i…

Think for a moment about the demographic Yiannopoulos is appealing to as victims: young English-speaking white men, perhaps the least victimized group of people in the world I'm not white (not unless there's a one drop rule for whiteness). Nevertheless, it is quite clear that these days the one demographic about which it is socially acceptable to talk unending amounts of shit is white men. That is not to say that white men are victims, but for fuck's sake, how much can a young white boy hear he'…

Batterer's intervention program. In California, probation for d.v. is commonly 3 years, requires the payment of restitution, community service, and the successful completion of a 52 week B.I.P. This is a statutory requirement. I managed to get terminated from every program I was in, including the last which was one on one counseling. The real question is, how did I successfully complete probation without meeting the statutory requirement? Extraordinary luck and an awesome public defender (the pa…

This almost reads like fiction. This judge needs to give some seminars in California: Camacho granted the motion for judgment of acquittal made by Meyer who said the defendant had a right to protect himself and was defending himself from his wife’s attacks. “It is troubling for the court that the prosecution automatically assumed the woman is the victim and the man is the abuser. Wow.

That article was gender neutral, but I suspect that men are most often accused of using the legal system to abuse their partner. In fact, an accusation I faced when attempting to gain custody of my child was that I was doing so to hurt my ex. I don't see why a man would willingly subject himself to the hell of family court to get back at his ex, but given its bias toward women, it makes sense that a woman would use the courts to abuse a man.

Unfortunately, the Justice for Men and Boys’ message seems incompatible with our very public campaigns specifically for women’s human rights here. So much for the "feminism will solve men's problems too!" argument. It's nice to see that Amnesty International is making very clear that feminism is about female supremacy, and nothing else.

Not sure how I feel about this anymore. Certainly it makes sense to protect access to abortion so long as it is permitted by law. But in most Western countries, the "right to choose" currently exists solely for the mother, and not for the life in question, nor for the father. I was once strongly pro-abortion, but I no longer understand the rational basis for that position. Why should the mother's preference override the baby's right to live? It may well be that some actions have serious conseque…

The slope gets slipperier: The Scout Association elected its first female chair. Ann Limb . . . has pledged to “Get more girls around the campfire” and to “help young boys understand what it is to be a young woman” with a view of “changing boys behavior”. U.K. scouting is a cautionary example against gender integration. Keep the BSA for boys.

/u/mattreyu, I was going to post the same thing. Clinton cleverly said that every "survivor" deserves to be "heard, believed, and supported," without providing an explanation as to how we are to distinguish the true survivors from the false accusers. Here is a link to the BSA national office contact information. I will be calling them to say that I am an Eagle Scout and that scouting was an important part of my youth. A key component of that was the all male environment, in which I learned from older boys and men lessons about how to comport myself as a man in our society, lessons that I firmly believe would be difficult if not impossible to impart in mixed gender groups. Given the declining opportunities today for boys to be around boys and…

It is heartening to see a woman publish a work laudatory of men at a time when vilifying men is so popular in the various major media. A couple of other things that stood out to me were this: “There are moments in life when we’re victimized,” she said, adding that being paid less than men in Hollywood doesn’t qualify as worthy of complaint, especially in comparison with girls facing genital mutilation and not being able to attend school in many countries. And this: While she has had several rela…

He's right. Violence against women is a men's issue. Because of feminist activism, there has been a decades long focus on violence against women in intimate relationships. Feminists have vilified men as potential batterers and rapists. Feminists have also glorified women as virtuous victims. Thanks to their decades of activism, this bias is now enshrined in laws throughout most of the United States and much of the rest of the world. The focus on violence against women: --allows women to render a…

Generally a good article? As a commenter on the article points out, the author claims that the Southern Poverty Law Center "called out" A Voice for Male Students for its "misogynistic bent," and then links to an SPLC article that does't say that at all. I can't answer your question in depth because I'm in the midst of a rather long work shift. That said, scouting is a fantastic organization in which to develop independence, teamwork, and leadership skills. For me, on the most fundamenta…

Scouting does offer an alternative for girls (Venturing), and of course there are Girl Scouts. But might men be unwilling to date women who are more successful precisely because, at the end of the day (and despite what they might say), women do prefer men who are more successful than them, and hence men suspect that such relationships have a high likelihood of failure? And are women's preferences innate, are they imposed by culture, or are they the result of some combination of the two? And, vice versa. False accusations: Shane got his first call from a district attorney a few months later. A nonverbal adult in Northampton, Mass., had accused someone of sexual assault while typing with her hand supported. The story turned out to be untrue, but it was not the only accusation of this kind. I feel like these sort of laws merely up the ante. I mean, if being caught up in a domestic violence case means that you face stiff penalties with minimal due process, then one reaction is to avoid any situation in which you could be plausibly accused of dv. The other is to cause true harm, that is enough harm to justify the punishment that's coming your way.

Students will ask, “Can I have sex when we are both drunk?” Ms. Zaloom said. “I get this one a lot: If I hook up with a girl and the next day she decides she didn’t want to do it, then what do I do?” Typically she will use such questions as a way to begin talking about the benefits of sexual partners knowing each other. I don't know. Sure, there's correlation, but a much more obvious issue is the fact that he was reportedly on the autism spectrum. This is not to say that autism = dangerous. But social rejection (which is not unusual for those on the spectrum) combined with the tendency of the autistic mind to focus obsessively on particular topics/ideas (let's say, firearms, mass shootings, and the urgent necessity of executing a mass shooting) can lead someone like Harper-Mercer to do what he did.

This law should have approximately zero impact. Well, except for lawsuits: The California Fair Pay Act builds on existing protections by prohibiting an employer from paying any of its employees at wage rates less than the rates paid to employees of the opposite sex for substantially similar work, not just for equal work or the exact same job title. There are going to be several trials before "substantially similar work" gains anything approaching a useful, generally recognized definition.
