Let me repeat this again, because you seem to have an even harder time than me understanding this conversation. If someone is drunk enough that they cannot legally consent, it does not matter what they say or do, engaging in sexual activity with them is still rape. Just like if a 10 year old says "yes" to sex, that is still rape because they cannot legally consent to sex. In this case, where a girl is unconscious or close to being so for the majority of the encounter, that is rape.

I don't see why you are getting such a negative response when you made such a great point. There is a huge difference between a situation where a woman is tired and doesn't really want to have sex but still let's her boyfriend get a quick one in for his benefit and a situation where a woman is scared to say no because she knows there would be a real negative consequence, such as being screamed at, threatened, or even raped anyway.

That goes against the basic argument I am making. A person's clothing should not be seen as something to consider in a rape case. A person's clothing does not negate that they were raped. Their clothing doesn't matter. What matters is whether the person consented. Clothing can not consent for you, no matter what it looks like.

Are you talking about in America or somewhere else? No one here has required military service, men do have to register for the draft but that's not really the same thing. (Just throwing this out there: I think the draft is completely unnecessary currently and that it should not exist at all.
