In fact, a lot of what is happening now in our society is trying to punish men for rape without involving the legal system that might investigate that rape. It was a misdemeanor - that's why the statute of limitation was so short (1 year I think?) The reason it was a misdemeanor is, if I understand correctly, that it was above the cloths and Crews wasn't restrained in any way. Still illegal, but on the lower end of offences.
