I don’t know what state you’re in, physically or mentally… but I’m in Texas - and I can move out and move on, property is property, there is no “I’m here so it’s mine” in tx. Also. See a lawyer, but anything in Texas acquired during the marriage is community property. Anything from before the marriage is individual- Yours, mine, ours Custody can be 50% with no support - But in short- see a lawyer. The sooner you start the sooner you’re finished. Why do people say filling first is a disadvantage? I’ve heard it both ways. I’m in Texas, I don’t see any advantage or disadvantage. And even if it does give you a disadvantage Freedom comes at a cost as well as happiness. Who cares about fault? Just get on with it already. the control won't change, you have to not only threaten, you have to follow through, otherwise you're doing to her the same thing she does to you. but to answer the question, yes, of course you can back out, you can get all the way to the courthouse and at the last minute tell the judge you don't want it, and if she agrees, case is dismissed without cause, and the only ones happy at that point are the lawyers
