Author here; it seems that there are starting to be murmurs of a conversation on college campuses - recognizing perhaps, that the Dear Colleague Letter went too far in exercising the sort of power that should be left either to the courts or to a vote in congress, and which would likely have failed constitutional muster under such scrutiny. I think one of the most disturbing parts is that a 16 year old was told he had 10 minutes to decide whether to take a plea bargain or go to trial; it's not clear whether he's referring to the DA or his attorney...but it's absolutely deplorable.

At least it seems that the conversation is being had again; I know administrators at at least one school are reconsidering their options - the more that we draw attention to this issue, the more likely that we'll actually be able to get the OCR to take back this problematic mandate.

The Times and Dartmouth articles just emphasize how ill-informed campus administrators and even the media are in regard to the burden of proof issue. That there was ever a point where preponderance was being considered for codification into law is troubling enough without feeling that those in power have no intention of even versing themselves in the facts.

Full disclosure, the site is my own - but if you are someone who is attending a US college or university, or are faculty/staff at one, the only way we're going to get colleges to challenge the OCR is to actually stand up for this issue and make your voice heard. I've written a template for a letter you can send to your school, as well as a general write-up for what the issues are around using the preponderance standard. CollegeJustice.org
