He should sue the state for the balance of the prevailing wage he should have earned doing the work that prisoners do for pennies an hour in prison. The state was unlawfully enriched for the work that he did without being paid the prevailing wage for it, and that difference should at minimum, cover the costs they're talking there, and possibly give him some money on the back-end, too. Of course, they'll fight like rabid dogs not to have to pay for it, because that's just how it works.
