I think the more important point would not be protecting people from the social stigma of being accused. The greater danger is false accusations leading to conviction and that is something that can happen and the idea of sending a rape victim to prison for some number of years should be considered equal to the possibility of sending someone who is innocent of rape to prison for that crime for what would likely be a much longer sentence.

I think you need to ask yourself why a principle works. Alot of this stuff is actually based off of some kind of basic psychology and most things have reasons for why they work. Some things can probably be expected to go both ways and some things can't. I think this touches on an idea of controlling your state (of mind). Basically, It take to much effort and thought to fake smile all night or focus on what your eyes are doing. When people know their is competition they are more pressured to make a decision. I heard an interesting argument against buying drinks. Its basically that people are attracted to people that they perceive as being higher up then themselves. We want people in our lives that will elevate us. Essentially you want to seem high class. One major trait of this is that a person of a higher class does not try to qualify themselves to someone of a lower class. Buying a drink, giving lots of compliments, etc. may all seem like nice things to do, but in reality they are detrimental.

I think with alot of stuff while people know what is going on they do not like it to be obvious. Even when you if you both now you are flirting its important that it remains sort of unspoken. I think the problem with not using them can be that nerves often cloud your mind and that discomfort comes through. I think they work well as a back up in case of lulls in conversation. There like a set play in sports. You have done them so much that you don't even have to think. The beauty of the set play isn't that it is some strategic gem. It works because even when your tired,nervous, scared, etc. you have that motion down and can do it without thinking.

I would suggest using canned openers and routines. I think if you go in with a plan and know what your going to say it may be able to get you over the initial discomfort so by the time you run out of prepared material you will feel comfortable enough to just participate in the conversation.
