I'm with what most everyone here has said, you should be asking your lawyer. However, almost any money she is receiving counts as income. I am not a lawyer, so bear in mind that all of my advice for entertainment value only. First - You should really look into why you are separated. Giving up after one year is ridiculous, you have most likely just gotten over the hardest year of marriage and now you are bailing when the hard work and suffering is most likely past.
