1	Because Rape doesn't have to be violent. One is not guilty of rape if it is forced upon them. This is the same for any crime. If someone forces you to commit a crime with the threat of physical violence, and you feel a danger to your life, you are not at fault for that crime, the person threatening you is. Besides, rape is the act of actively engaging is sexual relations with someone who does not or cannot consent. The prosecution of which only comes into play when one or both parties report the rape and/or choose to press charges (the governing parties prosecutor may or may not be able to press charges where applicable.) You can hold the record for most alcohol ingested by a human being in a single night, and still be able to rape. There is a difference, though, between a person initiating a specific sexual act, while denying that they consent to that act, and consenting to one act, but not another.
