At the end of the day judges are people and while in fringe cases a technicality can be the lynchpin in a case it is most often times not so. The woman photographed an unconscious mans penis and made lewd comments and got her medical license revoked. That wasnt her hospital alone that did that. It was a medical licensing board. There is no reasonable way to say the two things (photograph + firing) were unrelated
