As in, it's rooted in a fundamental misunderstanding of what the word 'rape' is defined as. People attach connotations to the word and readily assume that its not enough to call it sexual assault because you define rape as more serious, yet the law doesn't. Is it actually meted out? No, but it's possible. You can receive the same sentence for sexual assault as you can for rape, so a woman could be sentenced for the above for just as long as a man would be for rape.
