As someone who has not gotten divorced yet but has been on the cusp many times, this is one of the things that scares me the most. Yes, I’ll be overall happier. But if my son and/or daughter ever had another man playing dad in their lives I would be genuinely hurt.

Ridiculous to say she is 100% cheating. She does, however, understand that with the house mortgaged and having not worked and made any substantial income, she is likely going to come out decent financially from all of this. Unfortunately she probably hasn’t taken into account how much the lawyers will eat into her post divorce nest egg.

Yep the mediator said those were the two options. For option #2 (if mortgage can’t be assumed) she said there is a way around the “looking like you have a 350,000 debt to your name” part. Also they would set it up so after 2-3 missed payments I can force a sale.

I’m pretty simple and will not have any issues providing my kids a good life. My wife has some needs though, and if they’re not met her mental heath and ability to be a good mom will suffer. She’ll be with them half the time, so if I can help her be a better mom I’ll do that.

Three years the courts probably wouldn’t grant anything, and you’d be looking at paying a lawyer to fight for it as well as it would most likely put an end to the amicableness of the divorce. If you did get it you would get roughly $1,500 a month for half the length of the marriage…1.5 years. After lawyer fees you’d probably break even or come out a little ahead.

Take her to trial dude. You need half of the equity from the house and half the equity from her car. Tv, furniture, everything gets split down the middle. If you have $200,000 in your 401k and the house is worth $500,000, you can work in keeping your whole 401k and let her off the hook for $100,000 of her $250k she’ll owe from the house. Don’t get hosed.

It sounds like you’re trying to approach the subject reasonably and end things amicably. Idk what to tell you, but most responses you get here are from guys who act like they’ve been to war. I’ll get downvoted for this I’m sure, but imho not all divorces have to get nasty. Maybe talk to her, tell her how you feel, and asks if she wants to see a divorce mediator or each hire a lawyer.

Hire an attorney and get what’s rightfully yours. If she makes more than you, she should have to pay you. Get 50/50 custody. I’m pretty sure that’s a given unless there are unique circumstances. Don’t just “do what her lawyer says.” Don’t get fleeced.

Everyone has ups and downs in life. A loyal wife sticks through the hard times and supports her husband when he’s down. Yea it sucks to lose a job and be unemployed for an extended period of time, and it can create a lot of tension in a relationship. Families have gotten through worse though.
