It means that the onus is on the payor to come back to court at some point and ask for it to be terminated. Remember, SS in CA is about need, if need or ability to pay changes, that would probably be a good reason to ask for a modification or termination. | 1 | Does it matter who files first?There are some answers. Your SS length will be "reserved " because of the long term marriage or 10 year rule. Most likely you will not get a termination date now. The obligation to pay SS doesn't go away bc she works part time. The disparity between the incomes IS important regardless if she's working or not. You would have no venue issue if you still live together. Venue comes into play when two parties live in different counties or states and one wants to file and litigate in their county instead of the other. | 1 | Does it matter who files first?I am a CA family law attorney, and imo it makes no difference which party is first to file EXCEPT in situations (as one poster mentioned) where there are potentially multiple venues. However even in a case like that, the only "advantage would be venue" and not any advantage as to other substantive issues. If you're worried about getting "hometowned" just hire a local lawyer.
