Well, yeah. It's a tax increase carefully disguised to avoid outrage. I'm already annoyed that my ex moved 2000 miles away without telling me and I ended having to fund her lifestyle. But at least I don't have to deal with this new bullshit.

Oh...interesting. In US law the consequences of sexual assault are much less severe than rape. If the perpetrator faces the EXACT same penalties for either crime, then I would say the distinction is moot. Does this statute require that the rapist be the one with the penis? No. It's just defining the sex act. The sex act was nonconsensual. Hence she is a rapist, even under Montana law.

Where I live, rape is defined as nonconsensual sex. For instance, sex with a minor is always rape, since a minor can't give consent. Having an erection is not giving consent to have sex any more than a woman being wet is giving consent. It's a two way street, and many jurisdictions acknowledge this now.
