In a case such as you described where it's clear the rapist got off due to a very good lawyer then I'm assuming the state would choose not to seek criminal charges against the accuser. So in that case the defendant would have to decide if they wanted to pursue any legal action. However in other cases where it's painfully obvious that it's a false rape claim I think the state should prosecute and if found guilty then the false accuser should get a punishment on par with the punishment the false r…

Then the rapist would have to decide to prosecute or not. I'm not saying just because you beat a rape charge then the other person is guilty. If the person got off they should decide if they want to prosecute or not. If you're asking if there's a chance an innocent person could be convicted, then yes there is always that chance. Just like with all other crimes.

I completely agree. She definitely should be in jail though. Until an example is made false accusing will be an increasing trend. I understand not wanting to scare victims from coming forward, however when there's solid proof of a false claim that individual should be shown no mercy.
