Here is a devil's advocate situation that sounds plausible, though I don't know the law, so it may or not be reason to go through with OP's story's conclusion. Let's say that he told her he was a fighter pilot. She thinks that's super sexy and is turned on/wants him even though he is ugly. 60 sex later, he says he is sorry, but that he is really a unemployed pig farmer. Was it rape? I dunno, not really though it was under false pretenses.

Yes, but the books and diary don't have an infinite amount of horrid influences and contact with almost every human being on the planet, bad or good. He said she's not mentally well. That environment is likely not good for her, according to him. As a parent, that is his right to protect and ensure a healthy environment.
