I don't think the situation changes with two men. If you commit felony aggravated assault against somebody who committed simple assault on you, you wouldn't get a pass. EDIT: Removed stuff about mandatory prosecution that I was wrong about.

The law deals with the intent and the end result. Intent is very hard to prove. What Ray Rice was charged with, third degree aggravated assault is for either the attempt to cause bodily harm or causing bodily harm knowingly. Her unconsciousness is the proof of bodily harm. If he was caught using less force, he would have been charged with a lesser crime.

If he only slapped her, he could and should have been charged with a lesser charge, rather than the third-degree felony. Still a domestic assault charge. Before the facts came out BOTH were charged with simple assault.

Why is he charged when they both did the same thing They did NOT both do the same thing. The law distinguishes between just hitting someone and hitting someone in an attempt "to cause serious bodily injury to another" or "caus[ing] such injury purposely or knowingly." The DA interpretted being knocked unconscious as serious bodily injury (no disagreement from me). They were both originally charged with battery. After the first video tape was released, they dropped the charge against her and upgraded his charge to third-degree aggravated assault. Yes, she could have continued to have been charged with that misdemeanor, but her actions don't come close to causing or likely to cause grave bodily injury, which is the standard for the third-degree felony charge.
