The most obvious example of this is when a cop has to shoot a criminal and it hits and kills a pedestrian, the criminal is charged because they forced the cop to use that method of defense. Using a scenario that involves police action to justify a legal position that involves 2 non-cops is retarded. No one in their right mind would argue that cops are held to the same legal standards as the Average Joe.

Not if the person was trying to defend themselves from an attack. The reasoning is no different based in the weapon involved. If you're protecting yourself from assault by shooting your attacker, and you miss and hit someone else, you're getting charged -and likely convicted - for shooting that third party.
