Yes. I’m in Texas where spousal support kicks in after 10 years. Coincidentally 😒 the same number of years I was married… she was also a SAHM, not a good position for me and spousal support. Here’s how I kinda eliminated it and any future claims. Offered her a one time lump sum payout of $36k (which equates to $1500 per year for two years). For sure. I’d like to think she still had enough sense (but probably not) to realize if she took full payment now it would be gone in a year. Now she’s kinda put herself on a forced savings plan in which her income will be supplemented for the next 8 years. Thanks man! It’s a long story but that was always the deal or something along those lines. She actually had the highest rated, most recommended attorney in the area but she also found herself in between a rock and a hard place. Her attorney knew it. Truth be told, it started at like 13 years and $9500 a year to pay back. I would have settled at 5 years plus interest but she settled, presumably with the advice of her attorney on what I described. Expect to sell if you can’t come to an agreement. Here’s what I negotiated in our settlement to give you an idea of what’s possible but rare. I kept the house, with the ultra low interest rate and her name still on the deed and mortgage. She’s still entitled to her 50% equity which worked out be $102k based on today’s market value. Today marks the first weekend and full 5-day stretch without my three little girls since she moved out April 1st and we settled last week. Don’t even know what to do. More than anything, I’m worried about them and miss them. She has proven she doesn’t want them and is only following the custody schedule for child support. I’m also in Texas and just getting started. I don’t think they will consider this money as it was pre-divorce. Was your wife aware of all this at the time? If she wasn’t, that’s the only thing I can see that gets you hung up. I’m not a lawyer so don’t assume this is correct
