No that’s a factual question. If she didn’t tell the father of the birth and didn’t name him on the birth certificate then he isn’t gonna pay support anyways. What I’m saying is a woman can’t have it both ways. Decide she wants support for a while and then later decide to give it up without the man also getting a say.

If a woman leaves the baby at the fire station, the man has the right to take custody he wants. If he does so, he could then sue her for child support. It takes both parents to give up rights and not have the responsibility of parenting or child support.

Sure. A good prosecutor would put it all in as evidence. Just saying when you purposefully hit someone and run off it’s a totally different and more serious crime than hit and run.

Yeah totally. The leaving isn’t irrelevant. It’s evidence of motive. Just saying in that case she’s not getting charged with hit and run, she’d be charged with something worse.

She didn’t really leave though. And it seems like she did it on purpose. So even if she did leave I wouldn’t really call that a hit and run. She just tried to kill/injure a dude and ran off. Hit and run is for accidents that you then don’t stick around to report.

That’s the thing though. If you feel like you can’t escape, you don’t have to try. At the end of the day it all comes down to whether a jury thinks you could have avoided using force or not. It’s not that you can never use force, it’s that you shouldn’t unless you can’t.

The key there is try to reclaim the murder weapon. It’s not clear she was gonna get back in her car and hit him again. Also even with self defense if you can escape you have to, instead of using force against the attacker (no castle doctrine cause he’s not at home). Not that hard to avoid getting hit by a car in a parking lot so his self defense argument is weak.

More like she didn’t flee the scene in the first place. I’m no criminal lawyer, but pretty sure if someone starts beating your ass after you hit them with your car it’s not really a hit and run if you run.
