So what you're saying is that even if he asked for her ID, and she showed him a fake one, it would still be statutory rape? If that's the way out court system works, then we're fucked, because that ain't justice. I don't care if the creeps would just get fake ids. Since he took her there, you might be able to argue that he'd assumed some kind of duty as a babysitter or what have you That's bullshit. How could he have legally stopped her from attending a party at the hotel once they were there? Let's say she refused to leave, and he grabbed her and forced her into the car. I have to assume that would be illegal. He isn't her parent or guardian. "We went to the part"y simply means that they both went to the party. He didn't force her to go, nor does the law allow him to tell her what to do because she's not his kid and she's old enough to be out on her own. Hell, he didn't even drive her to the party, because the party was probably in a room in the hotel. He took her to the con. So its only delinquency if he personally handed her the alcohol at the party? And what evidence is there of that? And why would you even assume that when it would be easy enough for her to grab her own drink off the table? I've been to con parties, all the alcohol is just sitting there with cups on the table for anyone to grab. It surely can't be illegal to simply accompany a minor to a party where there is alcohol.
