There's no strata to consent. There's consent, and there's nonconsent. There is, however, strata to what you can infer about whether someone is really consenting willingly. Coerced consent is not consent. Reluctance is a big fucking clue. And like I said, you should probably think about that.

There's three separate sets of rights going on here. The right of people to not be raped. Obviously this one was violated, and that's totally shit. Well, let's say the trans person has made the effort to ensure their partner does know it's a possibility, then. I doubt your scenario is going to cause great emotional distress, though. I can only assume some people have triggers due to repressed sexuality and/or internalised homophobia, and it's only polite to warn them if you think facts about your medical history might cause them to have a massive sexuality crisis. I'd say it's also probably problematic if they've explicitly asked about one's status or otherwise made clear that they'd have an issue, but otherwise quite frankly it's not deception.
