I'm explaining why he doesn't have custody. Our courts aren't in the business of handing a kid off to a biological stranger based off a 15-minute court hearing and some documents portraying their authors in the best lights. In this situation of course it seems like they should, but that's not at all a power any judge should have. As arbitrary as "I made the kid" is as a measure of parenting ability, it is at least marginally fair.
