Lawyer chiming in here. Assault is the threat of immediate harm to another (summarizing the legal definition). Battery is the actual physical contact/harm to another. Not sure the jurisdiction here, but if she had a reasonable good faith belief that he was going to commit a battery (i.e., he has already committed and assault) then she may be entitled to defend herself with comparable force. The thing you have to understand here is that the report is being filtered through the lens of a legal motion. Her attorneys are merely trying to quash the subpoena seeking additional deposition time, and as such, will throw every inflammatory defensive argument at the wall to see if one sticks. I'm not excusing her conduct or even the legal strategy here, but that's what's going on.

Probably not just a case of pussy-pass but rather the legal system looking after their own, seeing as she is an attorney. As an attorney, I can almost guarantee this is not the case. Lawyers DO NOT look out for other lawyers like this, if ever. And certainly judges don't either. It's because assholes like her make our jobs more difficult. But beyond that, she is a headline. The tougher the sentence she receives, the more credit a young district attorney is going to get.
