Except that paternity testing is actually affordable, as in less than $400. Which is a great deal, and will save you a lot of money...if you've got $400. There are a lot of families out there who get to choose between eating this month and spending $400 - and families who've never even seen $400 in one place at the same time. Yeah, such families probably shouldn't be having kids in the first place, but this isn't a discussion about people who are making easy choices.

A trans person just has a frustrating birth defect they have to deal with. Some people are born with a leaky heart valve, other people are born with a body that insists on developing as a sex other than the person's brain is set up for. Changing the brain enough to deal with the problem destroys the person, so that's right out - the only remaining choice, imperfect as it is, is to let them change their body best we can.

Whats to stop some dude from 'declaring' himself feminine long enough to get a peek inside the women's room (or the reverse too)? Here's the thing. Bathrooms aren't divided based on gender identity, they're divided based in biological sex. Since no one is standing at the entrance performing genital checks before letting people in, what you'll actually find the bathrooms are divided based on is people's gender presentation - which gender's average appearance the person most closely fits.

Your first example is objective your second example is subjective. Race is a social construct, subjective based on varying interpretations of objective data points. So is gender. I would say that "cisgender" is the norm and "transgender" is not. There's a difference between identifying something as "the norm" and identifying a person as "abnormal". Most who don't see a problem with this have never been the person blithely dismissed as "abnormal" - which, when we're dealing with real live human beings, never ends up as a matter of pointing out an interesting variance from the norm, it always ends up as a package deal of treating the person as less than human.

Why does it have to be either cis/trans at this point? To me, if you're a man you're a man, if you're a woman you're a woman, if you're a MtF you're a woman, if you're a FtM you're a man. What do you mean by "safe to approach"? If you're attracted to someone, approach them and don't be a dick to them. If you're not attracted to someone, don't pester them. If it's necessary for your potential sex partners to have a penis or a vagina that they'd like you to play with, then tactfully ask them about it.
