There is no legislation that says between a father and mother, the mother is the preferred parent. If you look above, there is a comment explaining putative father registries. That legislation requires non marital fathers to register with the state when paternity is not established at birth. In Florida there are enumerated factors the court would look at to determine what is the children's best interest including a catch-all any relevant factor.
