2	Should DNA Testing be mandatory? There is no Sepreme Court decision on point. If the Supreme Court ruled on de facto parentage the likely ruling would be to declare it unconstitutional under the theory that mandating visitation with a de facto parent would violate the natural parents unenumerated constitutional right to raise their children with out interference from the State. 3	Should DNA Testing be mandatory? In my experience the 'father' will be found to be a de facto parent of the childfornwhm they are paying support for. To be found to be a de facto parent the 'father' should have to have a significant relationship with the child that was encouraged by the mother, and the 'father' held the child out as their own child to the public.
