Taking advantage of a drunk means to have them do something they wouldn't do sober. The drunk driver would be driving the car whether drunk or not. However, the drunk flirt probably wouldn't have fucked you if they weren't drunk. inb4 what if they would not have given me a ride when sober? I would assume any sober person aware of the situation will either stop the drunk driving from happening in the first place, or not be a passenger at all. That being said, emotional guilt aside, I would be against the passengers being held accountable; being a passenger to a drunk person is different from accepting sex offered by a drunk person. You're not taking advantage of the drunk person to get the both (or how ever many) of you killed.

Have to disagree on this one. While it is the responsibility of the drunk one to not be drunk in the first place, when one is drunk and getting flirty, it would also be the responsibility of the non-drunk individual to not take advantage of their drunken state. However, when drunk driving, the only one to be held responsible is the person doing the driving, all other are inanimate objects.
