depends where you are. in new jersey, sexual assault has replaced rape as a legal term. in PA, rape = use or threat of force, whereas sexual assault is any kind of intercourse without consent. in WA, sexual assault comprises anything that is a 'crime with a sexual motivation'. in SC, neither term is used, in stead "criminal sexual conduct", in FL it's 'sexual battery'.
