The different potential consequences is a reasonable point. I think the difference is marginal, though, as the crux of the crime is the invasion of a person's bodily integrity. The actual implement isn't so important from the victim's perspective. The woman's impact statement here illustrates that point effectively. That's why other jurisdictions--including the federal DOJ--would classify the conduct Turner was convicted of as rape. He was convicted of sexual assault with a foreign object. The difference between that and rape is that he used his fingers rather than his penis.
