No, there are a multitude of reasons why cases are dismissed not due to "merit". It's not law, google the equal pay act and the actual document will state is isn't law. It provides clarity. One, I don't think men are evil. Wealthy people who run companies aren't evil. They do this due to deeply ingrained sexism. Most of it is implicit bias. It's because women just want to be paid the same and keep their jobs. They don't want to spend legal fees to sue a company that she may not win (not due to the facts of the case but a multitude of other reasons) and then continue to work there. Do a simple cost benefit analysis, being paid $10,000/year when you have all the same incoming factors is just not worth suing for. Just. Pay. Them. The. Same.

You would measure exactly how the company measures it. In sales? Number of sales. Lawyer? Number of billable hours on specific types of cases. Women shouldn't be paid more than men, they should be paid the same for the same work. And that's an oxymoron. When they say 0.77 on the dollar, they mean women and men in the same job with similar education and experience. Obviously different fields are going to to get paid differently. We, meaning feminists, aren't talking across fields because obviously different pay levels would be indicative of difficulty not gender. We are only talking about the payment within the same job. Stop trying to dilute a message to demonize a theory supported by decades of data.
