I'm kind of torn on these things in general because carrying a baby and giving birth is an actual legitimate medical concern that will affect some women and no men. There will necessarily be an inequality of legitimate need for medical leave with regard to childbirth. But in this case, it sounds like he had a legitimate medical issue in his immediate family that he needed time off to address, so the generalities don't quite apply.

Incorrect on both. First, read more of the NJ law and English in general. "He" is gender-neutral. Second, it refers to an act of sexual penetration, not the actor (that is, the attacker, the person victimizing the victim) doing the penetrating. Being party to an act of penetration is all that is required to satisfy that part. The only thing it wouldn't cover is a forcible handjob (to a male) or non-penetrative stimulation such as to a clitoris (to a female).

Also, the "regardless of prosecution" isn't as awful as it sounds. All it does is allow for civil court redress, even without criminal charges. Well it looks like these are civil remedies. It's saying that the plaintiff can recover that if it's found to be the result of that act without there being any criminal prosecution of that act.
