I still don’t know where to start in my situation. Have decided I want a divorce, don’t know first step, but I do know I don’t want to waste attorney fees if we can mediate or whatever it’s called. The lawyer I spoke to said that living together while you try to persuade a judge that you’re separated is very difficult. This is important for spousal and child support in avoiding the 10 year marriage mark. He told me I should move out or she moves out ASAP to establish that date that says you aren’t actually living together. Maybe that’s not a concern for you but for me I will need to get separated before that 10 years or I could be paying spousal support to her forever, instead of just half…

This sounds similar to my situation. No kids with her. But I make more money and simply bought the dream classic car with my inheritance which I have in a trust. So I called a lawyer and spoke for a bit. He said yeah the dividends and basically all income from my separate property trust which I inherited is fair game for her spousal support. By uncontested do you mean she’s agreed to mediation and you both won’t be getting lawyers? I’m new to this process and also about to see a lawyer this week. I’m hoping for a peaceful and quick process but not holding my breath. Good luck to you.

Thanks guys. I’m still just worried what her initial reaction will be when I tell her I saw a lawyer. She’s trying to be nice today and I’m just being bummed. I don’t think she thinks I’m going to a lawyer.

Jay, I am right there with you buddy. I too have been depressed for far too long, and have decided that (depending on how long a divorce takes) 2020 will bring a new outlook on life.
