Nothing in the man's post suggests that he couldn't ask for custody of his son. He might not win, but he could at least try. Stranger things have happened. And even if the woman gets custody, it's not like it would mean he could never see his son again unless she files a restraining order on him or some crazy shit like that, which doesn't seem like it would happen in this case.
