I’ve been divorced twice. I didn’t initially marry until I was 29, married 10+ years and the divorce was very simple; no kids, separate accounts, split everything including proceeds from the house right down the middle. Second marriage was… and still is, 8 years after the divorce… a nightmare. Married at 44, had one kid and divorced about 10+ years later. Remarried at 60. File a police report. I’ve done it twice. The first time they sent out a cop to my home. The second time they took a report over the phone. Just went to her arraignment last week. She didn’t show, so now she has a permanent bench warrant for arrest for not showing up to the hearing. Makes it kinda hard to renew your drivers license, and if she gets pulled over she just might go to jail on the outstanding warrant.

Anything you want to keep hidden and keep for yourself; vehicles, boats, 4 wheelers etc., title them in the LLC name. I will say this: all of my vehicles are in an LLC. So if the kid is in school you can claim them as an “other” dependent. South Carolina is not a community property state. MFJ is usually more beneficial to both parents, and neither of you can claim HoH. So it’s either MFJ or MFS. I would look at what was withheld federally. I’d suggest “commingled” is the wrong word. There is marital property and separate property. Her basis in the 401K before marriage would probably be deemed separate property and any contributions and gain in the account post marriage would be deemed marital property. The summons should have included the original petition and the petition should have a detailed account of what you’re accused by the other party of doing. Not much, if anything, you can do to prevent Child Support. If you make more money, then you’ll be paying CS. Alimony depends on different factors. If you and her are anywhere close to the same income, then I wouldn’t worry about it, but if you make $250K/year and she’s a SAHM, then you’ll be paying alimony. It’s what you’ve paid towards the principle. Your down payment plus the principle amounts from your monthly payments. Mortgage payments are a combination of principle (the purchase price) plus interest plus escrow (insurance and property taxes).

If you’re covering the costs of maintaining the home, yeah, that’s marital debt/obligation. She’s on the hook for her half. She either reimbursed you of it increases your basis. If she doesn’t work, then it would increase your basis. So, rather than a 50/50 split it might be a 60/40 split on the equity.

What difference does it make what the house appraises at? If you keep it she gets half of the equity, not half the value of appraisal. If you sell it she gets half the proceeds.

They use the disclosure at the time of separation as long as you’re not accused of hiding anything. Other things can be considered like mortgages, utility bills, child support etc. If you’ve saved up some money, but she’s been paying the mortgage and the utilities, she’ll be awarded some kind of compensation. Hopefully you can work it out in mediation, cuz courts are notoriously bad at dividing assets.

I’ve never seen one for something like a self-directed IRA, but for any deferred income retirement account with an administrator I would think a QDRO is pretty standard procedure. Even military pensions go through a similar process.

Shares denotes an S corporation. Multi-member LLC denotes a partnership. Which one are you? A partnership doesn’t have shares, a partner has a percentage of the business. An S Corp doesn’t have members, it has shareholders. Does your business report activity on a form 1065 or a form 1120S?

Check with your attorney, but her claim to half your company equity may be a stretch. S Corporation? Then she gets shares, not the equity. Who is she going to sell those shares to? A shareholder in an S Corporation can’t just demand he/she be cashed out and the corporation required to buy him/her out. Check your operating agreement.
