Yeah, he could have, and in my other comments i've said that yeah, saying what he said in a lift was certainly misjudged. Doesn't mean that this is escalated to a potential rape though, which is the real issue.

Personally, i've never heard "he" used as a unisex term. Informally, "they" can be used as unisex even for singular people. But it's something of a moot point; in something which requires absolute clarity of meaning e.g. legislation "he or she" "him or her" "his or hers" etc are used (at least in UK articles of law)
