The mental health evaluation is given for anything at all. I got caught with a gram of weed and had 6 months of outpatient rehab and mandatory psychiatry for a year (which consisted of us discussing how stupid it is until my hour was up.) At the end of it all my probation officer asked why the psychiatrist never prescribed anything and I said "because its just weed. My entire sentence was unecessary." She shrugged and released me. No he should be given to the state because neither parent is fit to raise him. You have a choice between somebody who doesn't want it and somebody who will rape it one day.
