Thanks, you raise some great points in there.. I've tried living with this and take the higher road as often as I can, but sometimes life just isn't fair, it's frustrating and it makes you want to lose your shit. Thanks again. :)

The courts in Canada and particularly BC try to put the needs of the child first, and to include both parents as much as possible. I'm hoping they see this as 11 years of saying fu to the courts and do something about it. Germany is part of the Hague convention but from what I heard is not likely to return a child. The US, I'm not sure of.

it falls under the Hague convention which both Ireland and the UK are members of. That's how she was returned the first time. The courts listen to all parties and make a decision based on what they believe is the best interests of the child. Understand this, my issue is with how her mom has acted, not with the fact she's there. I was and always have been extremely open to discussions on all matters related to our kid, her mom, has not, never has been, and by the looks of it never will be.

Yes in hindsight it was, actually guardianship is the key in this. My philosophy was, tough shit, our relationship didn't work, we have a kid to raise and let's just focus on that. A few lawyers at the time said throw the book at her, I should have because she had never respected the courts, nor acknowledged her wrongdoing

I'm not serious, just angry - and wishing I could unleash holy hell on her, but know I can't. Well, I am looking to talk to a lawyer, discuss pressing charges etc.. there is already a court order in place, and ten years ago my daughter was returned under the Hague convention. It took me 2 months to get the court order in place to be able to get my kid back to Canada. There is a custody order in place, and has been for 10 years, she is breaking that.
