The evidence is the passage of tissue, maybe complications that land her in the ER, etc. So you'd need to adopt a strict position/legislation that didn't allow the woman to be charged, and at best try and defend criminalizing possession of abortificants, which the possession or purchase of which wouldn't be indisputable evidence, so I don't see how you're getting murder convictions.
